General charter terms and conditions

General obligations

The Client affirms their possession of a valid navigation license, approved by the Croatian Ministry of the Seas, suitable for the boat's gross tonnage. They also assert authorization to independently operate the boat's radio station and undertake the responsibility to handle the vessel diligently, adhering to the standards of a prudent mariner. Additionally, the Client agrees to maintain a personal logbook and, in the event of any damage, to promptly submit it for review.

The Client is prohibited from engaging in regattas without obtaining prior written consent and must adhere to the regulations set forth by local and port authorities. It is imperative that the Client refrains from transporting undeclared, dutiable goods, or any other prohibited items. Furthermore, departure from Croatian territorial waters is strictly forbidden without obtaining written approval - a Permit - issued by Navigare–Solutions

Charter Fee

The yacht charter fee covers the usage of the vessel and its equipment. Any additional expenses will be calculated separately and are not eligible for refund in the event of a charter cost reimbursement. Marina fees, fuel, comfort package fees, Croatian tourist tax, water, food, drinks, and any other expenses necessary for the proper operation of the vessel during sailing are not included in the charter fee.

Payment Type

The Client is required to make a payment of 100% of the charter price within 5 working days to confirm the booking. The Client will be permitted to take over the boat only upon completion of all necessary payments. In the event of obvious pricing errors, both Navigare Solutions and the Client are responsible for rectifying the price according to the existing price list, with no impact on the validity of the contract. Failure to receive any scheduled payment by the due date grants Navigare Solutions the right to cancel the charter.

Acceptance of the yacht

Upon handover to the Charterer, the yacht must be fully fueled. The Charterer is responsible for inspecting and confirming the yacht's condition and equipment completeness as per the checklist, in the presence of local staff. The conditional acceptance of the vessel by the chartering party signifies the Charterer's acknowledgment of the yacht's fully functional condition and commitment to immediately test all systems upon departing the marina. Should any defects arise, the Charterer must return to the marina to allow local crew to rectify them. Otherwise, the yacht is deemed to have been delivered in perfect condition. Any agreed security deposit must be provided in cash. The owner reserves the right to deduct the security deposit against charges exceeding average depreciation costs and not covered by insurance, or for any lost equipment items. Alternatively, the security deposit must be promptly refunded upon confirmation of the yacht's satisfactory return, barring any other circumstances.

Security deposit

The Charterer is on his arrival in Charter Base obligated to leave security deposit. The deposit may be paid in cash and will be reimbursed to Charterer once the boat has been returned and satisfactorily inspected. The deposit will be reimbursed in full only where no damage has been caused to the boat or its equipment, or to third parties. If Charterer reports damage, or the Navigare Solutions discovers during inspection that the boat or its equipment is damaged, or piece of equipment or inventory is missing, Navigare Solutions will retain part or all the deposit, equal to the cost of repairs or replacement of missing equipment.

Cancelation of the reservation

Cancellation more than Two Months Prior to Charter Commencement:

  • If the Charterer decides to cancel the charter more than two months before the scheduled beginning of the charter period, Navigare Solutions will retain 25% of the total charter price as compensation for administrative and operational expenses incurred.

Cancellation Within Two Months of Charter Commencement:

  • In the event of a cancellation within two months of the scheduled charter period, the Charterer will be subject to a cancellation fee equal to 50% of the total charter price. This fee compensates Navigare Solutions for the loss of potential bookings and operational costs associated with the preparation of the vessel for the charter.

Cancellation Within One Month of Charter Commencement:

  • If the Charterer cancels the charter within one month of the scheduled charter period, Navigare Solutions will retain the full 100% of the charter price. This policy is in place to mitigate the financial impact of last-minute cancellations on Navigare Solutions business operations and to compensate for the loss of revenue from the reserved charter slot.

Navigare Solutions understands that unforeseen circumstances may arise, leading to the need for cancellation. However, due to the nature of the charter industry and the advanced preparations required for each booking, the cancellation policy is necessary to ensure the fair treatment of both the Charterer and Navigare Solutions.

Insurance

Our vessel is covered by Wiena insurance grupe. Casco insurance, and all pertinent details of the insurance policy are provided in the attached ship's papers.

Check in procedure

The check-in day offers flexibility and can be mutually agreed upon between the charterer and the charterer. Check-in time begins at 14:00 p.m. on the agreed-upon charter start date.

Obligation to return to the base a day prior to check-out time by 17:00 h.

In the event of a one day charter the booking is constricted from 10:00 h till 18:00 h.

Delays will be charged at 50 euros per hour.

Check-out time is set no later than 9:00 h on the final day of the charter.

The minimum charter duration is seven days, unless alternative arrangements have been agreed upon between Navigare Solutions and the charterer.

Yacht return

The boat should be returned, in working order, with complete equipment and full tank. The Charterer assumes obligation to compile a written list of detected defects and missing or lost objects. All the boat documents should be returned to the base office.

An extension of the charter period is possible only with Navigare Solutions. If the Charterer does not return the boat at the correct time and in the correct location, the Charterer agrees to pay 200% of the daily rate for each started date overdue.

Client obligation

The Client acknowledges and accepts the following terms:

  • The vessel must not be entrusted to any third parties.
  • The vessel is strictly prohibited from being used for any commercial purposes.
  • The number of individuals boarding the vessel must not exceed the limit specified on the crew list.
  • Compliance with the laws of the host country is obligatory.
  • Fishing and submarine activities are not allowed without valid licenses.
  • Prior written consent is required for bringing any pets (such as dogs, cats, birds, etc.) aboard.
  • The Client assumes full liability for any damage inflicted upon the vessel, its equipment, or interior inventory (including window glasses, upholstery, woodwork, etc.), whether caused by themselves or other passengers.
  • All safety instructions provided by the vessel's skipper must be adhered to, in accordance with international marine law which designates the skipper as the primary responsible party for both passengers and the vessel's safety.
  • The Client bears responsibility for covering all operational costs for themselves and their guests for the entire duration of the charter period.

Should Navigare Solutions determine that the Charterer or any members of their crew lack the requisite knowledge and nautical skills necessary for the safe operation of the vessel, Navigare Solutions reserves the right to require the Charterer to engage a qualified skipper for either a portion or the entirety of the contractual period. Any associated costs incurred because of this arrangement will be the responsibility of the Charterer.

Navigare Solutions is empowered to impose such restrictions in situations where adverse weather conditions or other serious circumstances necessitate such action, prioritizing the safety and security of all parties involved.

Skipper obligations and responsibilities

The skipper's responsibilities include navigation, mooring, anchoring, and maneuvering the vessel while ensuring the deck and cockpit are kept clean and in optimal working condition.

  • The skipper is expected to provide the Client with tourist information and share local knowledge about anchorages, attractions, restaurants, and water sports locations, acting as a knowledgeable "host" for the passengers.
  • The skipper must remain on board and vigilant when the vessel is anchored, ensuring the safety of passengers and the yacht, both day and night.
  • Consulting with the Client, the skipper determines the desired sailing schedule and route, balancing safety considerations with passenger enjoyment.
  • In cases of adverse weather conditions, the skipper decides whether it is safe to depart from port, communicating the situation to the Client and mutually agreeing on alternative plans.
  • Based on weather conditions and forecasts, the skipper determines whether spending the night in a port or anchoring in a bay is advisable.
  • The skipper has the authority to prohibit the use of water sports equipment by the Client or guests if they are deemed incompetent, irresponsible, or endangering others.
  • Full responsibility lies with the skipper for mooring the vessel, refilling water, diesel, and fuel for the outboard engine, as well as handling port formalities.
  • The skipper is accountable for any damage to the vessel or its equipment during sailing, motoring, anchoring, mooring, and maneuvering.

Place of jurisdiction

Any dispute hereunder, which the Parties have not been able to settle amicably, shall be decided in accordance with Croatian Law. The court of jurisdiction is the court in Split.

Confirming the booking, the Charterer declares that he has read these terms and conditions and that he accepts them with full understanding.
